Ministerstvo zahraničných vecí a európskych záležitostí Slovenskej republiky oznamuje, že výmenou nót z 18. apríla 2017 a 30. júna 2017 bola uzavretá zmena Dohody medzi vládou Slovenskej republiky a vládou Spojených štátov amerických, týkajúcej sa Komisie J. Williama Fulbrighta pre vzdelávacie výmeny v Slovenskej republike, podpísanej 22. marca 2005 v Bratislave (oznámenie č. 198/2005 Z. z.). Zmena dohody nadobudla platnosť 30. júla 2017.

Ministerstvo zahraničných vecí a európskych záležitostí Slovenskej republiky prejavuje úctu Veľvyslanectvu Spojených štátov amerických v Bratislave a má česť odvolať sa na verbálnu nótu veľvyslanectva č. 31 z 18. apríla 2017, týkajúcu sa Dohody medzi vládou Spojených štátov amerických a vládou Slovenskej republiky, týkajúcej sa Komisie J. Williama Fulbrighta pre vzdelávacie výmeny v Slovenskej republike, podpísanej 22. marca 2005 v Bratislave v nasledujúcom znení:

„Veľvyslanectvo Spojených štátov amerických (ďalej len „Veľvyslanectvo“) prejavuje úctu Ministerstvu zahraničných vecí a európskych záležitostí Slovenskej republiky (ďalej len „Ministerstvo“) a má česť odvolať sa na Dohodu medzi vládou Spojených štátov amerických a vládou Slovenskej republiky, týkajúcu sa Komisie J. Williama Fulbrighta pre vzdelávacie výmeny v Slovenskej republike, podpísanú 22. marca 2005 v Bratislave – s platnosťou od 21. apríla 2005 a s účinnosťou od 23. septembra 2004 (ďalej len „Dohoda“).

Veľvyslanectvo v mene vlády Spojených štátov amerických navrhuje podľa článku 10 ods. A) zmeniť článok 7. ods. B) takto:

„B) Spojené štáty americké, v súlade s platnými zákonmi a právnymi predpismi, vydajú držiteľom štipendií a ich priamym rodinným príslušníkom príslušné neprisťahovalecké víza, za ktoré budú odpustené správne poplatky.

Slovenská republika, v súlade s platnými zákonmi a právnymi predpismi, vydá držiteľom štipendií a ich priamym rodinným príslušníkom príslušné národné víza (D víza), za ktoré budú odpustené správne poplatky.

Každá zmluvná strana zaručuje, že pobyt držiteľa štipendia v prijímajúcej krajine nezávisí od povolenia na zamestnanie.“.

Veľvyslanectvo ďalej navrhuje, že z článku 7 sa úplne vypustí odsek D).

Ak sú uvedené návrhy pre Ministerstvo prijateľné, Veľvyslanectvo navrhuje, aby táto nóta a v jej zmysle odpovedná nóta Ministerstva ustanovili súhlas medzi oboma vládami zmeniť Dohodu, ktorá nadobudne platnosť tridsiatym dňom od prijatia odpovednej nóty Ministerstva.

Veľvyslanectvo využíva túto príležitosť, aby ubezpečilo Ministerstvo o svojej najhlbšej úcte.“.

Ministerstvo má česť potvrdiť, že vláda Slovenskej republiky plne súhlasí s obsahom verbálnej nóty Veľvyslanectva a s navrhovanými zmenami Dohody.

Tým nóta Veľvyslanectva č. 31 z 18. apríla 2017 a táto nóta predstavujú súhlas medzi vládou Slovenskej republiky a vládou Spojených štátov amerických zmeniť Dohodu, ktorá nadobudne platnosť tridsiatym dňom od prijatia tejto nóty, t. j. 30. júla 2017.

Ministerstvo využíva túto príležitosť, aby ubezpečilo Veľvyslanectvo o svojej najhlbšej úcte.

Ministry of Foreign and European Affairs of the Slovak Republic presents its compliments to the Embassy of the United Stated of America in Bratislava and has the honour to refer to the Embassy's Note Verbale No. 31 dated 18 April 2017 concerning the Agreement between the Government of the Slovak Republic and the Government of the United States of America Concerning the J. William Fulbright Commission for Educational Exchange in the Slovak Republic, done at Bratislava on 22 March 2005, which reads as follows:

“The Embassy of the United States of America („the Embassy“) presents its compliments to the Ministry of Foreign and European Affairs of the Slovak Republic and has the honour refers to the Agreement between the Government of the United States of America and the Government of the Slovak Republic Concerning the J. William Fulbright Commission for Education Exchange in the Slovak Republic, done at Bratislava on 22 March 2005, with an entry into force date of April 21, 2005, and an effective date of September 23, 2004 (hereinafter referred to as “Agreement“).

The Embassy, on behalf of the Government of the United States of America, proposes that, pursuant to Article 10, paragraph A of the Agreement, Article 7, paragraph B of the Agreement be amended to read as follows:

“B) The United States of America shall issue scholarship recipients and their dependents appropriate non-immigrant visas, consistent with its applicable laws and regulations, for which there shall be no associated administrative fees.

The Slovak Republic shall issue scholarship recipients and their dependents appropriate national visas (“D” visas), consistent with its applicable laws and regulations, for which there shall be no associated administrative fees.

Each Party guarantees that the scholarship recipient’s stay in the receiving country does not depend on issuance of a work permit. ”

The Embassy proposes further that existing Article 7, paragraph D be deleted in its entirety.

If the foregoing proposals are acceptable to the Ministry, the Embassy proposes that this note, and the Ministry’s note in reply to that effect, shall constitute an agreement between the two Governments to amend the Agreement, which shall enter into force on the 30th day after the date of the Ministry’s note in reply.

The Embassy of the United States of America avails itself of this opportunity to renew to the Ministry of Foreign and European Affairs of the Slovak Republic the assurances of its highest consideration.”

The Ministry has the honour to confirm that the Government of the Slovak Republic agrees fully with the content of the Embassy's Note Verbale and with its proposed amendments to the Agreement.

Thus, the Embassy's note No. 31 dated April 18, 2017 and this note shall constitute an Agreement between the Government of the Slovak Republic and the Government of the United States of America to amend the Agreement between the Government of the Slovak Republic and the Government of the United States of America Concerning the J. William Fulbright Commission for Education Exchange in the Slovak Republic, done at Bratislava on 22 March 2005, which shall enter into force on the 30th day after the date of this Note Verbale, i.e. on 30 July 2017.

Ministry of Foreign and European Affairs of the Slovak Republic avails itself of this opportunity to renew The Embassy of the United States of America in Bratislava the assurances of its highest consideration.
